Bills would toughen penalties for DUI

FRANKFORT — People caught driving drunk just once could be forced to install breath-alcohol monitoring devices in their cars, as Kentucky lawmakers consider toughening the state’s DUI laws.

House lawmakers are considering proposals aimed at increasing the use of ignition locks, which require people to prove they’re not drunk by blowing into a device before starting their vehicles. Another plan would also decrease the current blood-alcohol level that triggers an aggravating factor in DUI sentencing.

“The problem is we’ve got people that are driving 100 times before they even get caught drinking and driving,” said state Rep. Dennis Keene, D-Wilder. “A lot of these people re-offend, and this would curtail them from using their car while they’re out drinking and driving. There’s a tremendous call for this.”

Richmond Crimes of the Day

The following crimes and arrests were reported to the Richmond Police Department between Jan. 7 and Jan. 8, according to the department:

Theft of Vehicle: On 01/07/2009, a patron of Clark Shell on the Eastern Bypass reported the theft of prescription medication from her vehicle while she was inside the business. The victim stated that she left her prescription for Xanax on the passenger seat of the unlocked vehicle while she went inside the business. The prescription contained 28 pills and was still in the pharmacy bag.

Theft of Credit Cards: On 01/07/2009, an official of the First Presbyterian Church on West Main Street reported the theft of four charge/credit cards from the office. The cards were from Walmart, OfficeMax, BP and Kroger. There was no evidence the cards had been used since the theft.

Theft of Drugs: On 01/07/2009, a resident of Hines Motel reported the theft of a gold “pinky ring” and a prescription drugs from his room. The victim stated that approximately 40 hydrocodone pills had been stolen. There were no signs of forced entry into the room. Estimated loss: $325.00

Vehicle Shot: On 01/07/2009, the operator of a handicapped van owned by P Cab Company of Berea reported a gun shot penetrated his vehicle while he was parked on Commercial Drive near Richmond Active Day Care Center. The operator of the vehicle was sitting in the vehicle waiting to pick up riders when he heard a shattering sound. Upon inspecting the vehicle, the operator found a bullet hole through two rear windows. The round had apparently passed cleanly through the vehicle from one side to the other. Officers checked the surrounding areas but were unable to locate any suspects. The operator did not hear a gunshot.

Theft of Bicycle: On 01/07/2009, a resident in the 1100 block of West Main Street reported the theft of a bicycle from her garage. The victim described the bike as a Smoothie10-speed, blue in color, with a large seat. Estimated loss: $400.00

Theft from Vehicle: On 01/08/2009, a patron of Outback Steakhouse reported the theft of a tool kit from the bed of his pickup truck while it was parked at the establishment. The victim reported noticing that his bed-mounted tool box was slightly ajar when he returned to his vehicle. Upon inspection, he found the tool kit missing. The kit was described as a Craftsman Mechanics kit in a hard plastic Craftsman case. Estimated loss: $150.00

Burglary: On 01/08/2009, a resident of the Hines Motel reported a number of items stolen from his room. The victim stated that he believed his room had been entered on at least three prior occasions, none of which were reported to police. The victim reported a gold colored men’s watch, a women’s watch, two gold cross earrings, a knife and $50.00 in cash were stolen in the burglaries. There were no signs of forced entry to the room.

Estimated loss: $300.00

Theft from Vehicle: On 01/08/2009, a resident of an apartment in the 100 block of Meadowlark Drive reported the theft of 20 CD’s from her unlocked vehicle while it was parked during the overnight hours. Estimated loss: $100.00

Burglary of Business: On 01/08/2009, the Richmond Regional Oncology Center reported that someone had unlawfully entered the business between 01/06 and 01/08/2009 and stolen a red Nikon Coolpix camera. There were no signs of forced entry. Estimated loss: $200.00

Theft from Vehicle: On 01/08/2009, a resident in the 100 block of Robbins Drive reported a theft from his unlocked vehicle while it was parked during the overnight hours. The victim reported that a pair of Nike Lebron James basketball shoes were stolen along with a Nike backpack, two bottles of cologne and 20 CD’s. Estimated loss: $435.00

Theft from Vehicle: On 01/08/2009, a resident of an apartment in the 100 block of S. Killarney Lane reported the theft of a number of items from her unlocked vehicle while it was parked during the overnight hours. The victim reported that a brown Coach purse, 40 CD’s, some baking pans and a bottle of perfume had been stolen from the vehicle. Estimated loss: $296.00

Arrests: The following arrests/citations occurred on 01/08/2009:

Holly A. VanZandt, age 42, Ashley Court, Berea, was charged for DUI, Resisting Arrest, Unlawful Imprisonment 2nd Degree and Illegal Possession of a Legend Drug after an incident on Duncannon Lane wherein VanZandt forced another vehicle to stop. A complainant reported that VanZandt had nearly struck her vehicle several times and finally forced the complainant to pull to the side of the road where VanZandt blocked her in, thus preventing the complainant from leaving. Officers suspected VanZandt of being under the influence of an intoxicant and arrested her. A Levoxyl pill was found in her purse with no indication of a prescription.

Jason L. Murrell-Deaton, age 26, Lancaster, KY, was charged for Possession of a Controlled Substance 3rd Degree after he was found in possession of a prescription bottle of pills not belonging to him. The discovery was made when officers wee called to the Walmart parking lot to investigate suspicious activity involving Murrell-Deaton and another party.

Jerry L. McGee, age 37, Dixie Plaza, Richmond, was charged for Assault 4th Degree (Domestic Violence) after he allegedly twisted the arm of his 79-year –old father, causing minor injury, during an argument at the residence they share.

Steven A. Carl, age 40, Lowery Heights, Richmond, was charged for Possession of Marijuana and Tampering with Evidence after a traffic stop on N. Madison Avenue. After being stopped, Carl attempted to destroy marijuana in his possession by eating it.

Michelle D. Kelley, age 23, Keeneland Drive, Richmond, was charged for Possession of a Controlled Substance 3rd Degree following a traffic stop on Turpin Drive. Kelley was found to be operating the vehicle without a license and was arrested. A search of her vehicle produced a number of Schedule V controlled substances in an unmarked bottle.

Lexington man charged with murder

A Lexington man has been charged with murder in the shooting death of a man found outside a bar in July.

Yves M. Garner, 31, was charged Wednesday with murder of Henry Means, 35, who was shot multiple times and found about 11:30 p.m. July 20 outside the Around the Korner bar on Anniston Drive, off Eastland Parkway.

Means was taken to University of Kentucky Medical Center where he later died.

Garner has also been charged with tampering with physical evidence. He is being held at the Fayette County jail.

2 charged in alleged counterfeit scam in Boyle Co.

Boyle County police are hearing from victims of an alleged scam involving counterfeit traveler’s checks, cashier’s checks and money orders.

The scheme came to light Tuesday night in Boyle County, and led police to find $161,300 worth of fake documents in a Nicholasville apartment.

“Right now, I’ve got people from all over the state of Kentucky who have been scammed by this program,” said Boyle County Deputy Sheriff Marty Elliott. “I’ve never seen anything of this nature.”

Two people have been arrested and a third arrest is coming, Elliott said.

Tammy Gomez, 42, of Nicholasville, and Timothy Preston, 39, of Harrodsburg were both charged with two counts of second-degree criminal possession of a forged instrument, a felony. They remain lodged in the Boyle County jail.

Elliott said Preston attempted to pass a counterfeit document Tuesday night at the Trading Post convenience store in Parksville, a community southwest of Danville.

Employees were wary about the document, Elliot said, because a similar document had previously passed at that store. That document came back from the bank stamped “counterfeit.”

The store alerted 911 and employees continued to talk to Preston until police arrived and detained him, Elliott said.

Gomez, meanwhile, left the store in a vehicle but was stopped by police in nearby Junction City, east of Parksville. During a search of the vehicle, police found United Parcel Service receipts for documents sent all over the United States, including Texas, California, New Mexico, New York and Wisconsin.

A search of the Gomez apartment on Beauford Place in Nicholasville uncovered $161,300 worth of traveler’s checks, cashier’s check and money orders that were about to be distributed, Elliott said.

Police were told the documents originated in South Africa. Gomez and Preston were to distribute the documents from Central Kentucky to addresses throughout the country. The people would then cash them and send part of the proceeds back to Gomez and Preston, who in turn would wire money to South Africa. The two were then to receive 10 percent of the proceeds.

Elliott said he doesn’t think there is a South African connection. He suspects that Preston and Gomez were themselves being scammed by “somebody in the states.”

In any case, “Several people from other counties are calling me, telling me they’ve been affected by this,” Elliott said. “We’re getting banks contacting us, saying ‘We’ve cashed these things.’”

Elliott said he intends to contact the U.S. Treasury Department or the FBI about the matter. Kentucky State Police have also expressed interest in the operation, he said.

Boyle Deputy Sheriffs Al Isaacs and Derek Robbins are assisting in the investigation.

Child found dead in vehicle in Laurel County

A 2 ½-year-old boy was found dead inside a locked vehicle Friday afternoon in London.

Madison Nose was found inside a Suzuki SUV with the windows rolled up about 4:30 p.m. The vehicle was parked in a parking lot near St. Joseph’s Hospital.

It appears as though the boy’s grandmother, who has not been identified, forgot to take him to day care and went to work at the hospital. The child was left in the back seat of the vehicle all day. He died of hyperthermia, Laurel County Coroner Douglas Bowling said.

Temperatures were in the low 80s in London on Friday. It likely was much hotter in the vehicle, Bowling said, but he could not say how hot.

Police took the woman into custody, but it was not clear whether she would face charges, Bowling said.

UPDATE: Lexington police seek woman after surrounding rural house

Police and emergency crews spent much of Wednesday night on a rural Lexington road after a report of a person barricaded in a house.

Kiddville Lane off Jacks Creek Pike was closed to traffic and filled with police cruisers, the emergency response unit’s vehicles and fire trucks.

Some residents who lived on or near the scene were forced leave their cars and walk to their homes.

After several hours, it was determined that the woman thought to be barricaded in the house was not there, Lexington police Lt. Richard Bottoms said.

Early Thursday, he confirmed that police were looking for Sharon Krimm, 60, who was possiibly driving a white Mitsubishi Montero and could have a handgun.

Police: Be aware of student loan phone scam

NICHOLASVILLE — Police warned residents Friday about a telephone scam involving past-due loans.

During the calls, residents are told to send money to get current on a loan.

“The caller will try to convince you that you can avoid defaulting on your loan by sending the payment to their processing center immediately,” Nicholasville police said in a release. “This is an old scam and unfortunately it is still used today.”

Police said the targets tend to be elderly people who might be intimidated by callers. The scam uses a “private listing” phone to prevent people from seeing the number from which the call originates.

Police reminded residents never to give personal information over the phone, especially when you did not place the call.

Reckless driving leads to an arrest

A couple in Corbin was charged with possession of a controlled substance after an officer received a call for a reckless driver.

The Corbin News Journal reports the officer observed the vehicle sitting beside a gas pumps for several minutes. The officer investigated further because the motorist didn’t get any gas, but they appeared to be doing something in the car, the officer said.

Nine die during Memorial Day weekend

Nine people died in nine separate crashes on Kentucky roadways during Memorial Day weekend, from 6 p.m. Friday to 11:59 p.m. Monday, Kentucky State Police said.

According to preliminary statistics, three people died in car wrecks in Barren, Boone and Fayette counties. Four people died in all-terrain vehicle wrecks in Floyd, Harlan, Pike and Rockcastle counties. One person who died was on a motorcycle in McCracken County. And a pedestrian died in Fayette County.

Two of the three people in car wrecks were not wearing seat belts, and alcohol was suspected in one of the three crashes. Three of the four victims of ATV wrecks were not wearing helmets. State police did not release any other information about the motorcycle wreck in McCracken County.

There were eight fatalities in eight crashes on Kentucky roads during the Memorial Day weekend last year.
