Man hit with bottle outside McDonald’s

Police were searching Monday morning for three suspects involved in an assault and attempted robbery outside a Lexington McDonald’s.

A man told police he was renting a DVD from a Redbox kiosk shortly after 2 a.m. Monday outside the McDonald’s, 2321 Versailles Road, when a man approached him and asked for five dollars. He declined and the unknown suspect struck him in the head with a bottle, said Chris Sutton, a Lexington police spokesman.

The man ran to his car and the suspect threw the bottle at him striking him in the eye. He sustained only minor injuries, Sutton said.

A second suspect tried to get into the man’s vehicle, but did not. One of the vehicle’s windows was broken, he told police.

The two suspects fled with a third person toward an apartment complex behind the restaurant. Police searched the area, but could not find them, Sutton said.

The first suspect was described as a Hispanic man between 20 to 25 years, about 5-foot-9. He had a thin-line beard and wore a black hooded sweatshirt and black shorts, Sutton said. There was no description of the other two suspects.

Arraignment set for Bed Bath & Beyond manager

A manager at Bed Bath & Beyond will be arraigned Sept. 25 in Fayette District Court for allegedly failing to help a child who was locked inside a hot van.

Elizabeth A. Miller, 34, of Richmond was charged last week with duty to report dependency, neglect and abuse after police learned she allegedly refused to call police for a Danville couple who found a 3-year-old locked in a hot van in the parking lot of the housewares store on Nicholasville Road. Miller told the couple that it was against store policy to get involved in activities in its parking lot, which a Bed Bath & Beyond corporate spokesman said was not the chain’s policy.

The charge is a misdemeanor.

If convicted, Miller could face a maximum of 90 days in jail and a $250 fine

Man lets police search computer, faces 44 sex charges

A Fayette County grand jury has indicted a Lexington man on 44 charges of sodomy and child pornography.

David M. Allen, 36, is charged with six counts of sodomizing a child under the age of 12, 31 counts of using a minor in a sexual performance (either illicitly filming or photographing a minor), six counts of first-degree sex abuse and one count of possessing matter portraying a sexual performance by a minor.

The indictment was made public Wednesday.

Allen, who works for an electrical contractor in Lexington, is being held in the Fayette County Detention Center on $405,000 bond. He will be arraigned Thursday in Fayette Circuit Court.

According to the indictment, Allen sodomized a child on six occasions from March to May 2008. The accusations that he filmed or photographed minors date back to December 2006.

Fayette Commonwealth’s Attorney Ray Larson declined to comment on the case because it is still pending. Court records did not indicate how he knew the children.

According to a police report, Allen agreed in June to allow police to search his computer. Police said they found images that were suspected to be child pornography.

“The subject stated he had more child pornography on other media,” the police report states.
