A grand jury will hear the case against two men accused of hanging an effigy of President-elect Barack Obama.
A Fayette District Court preliminary hearing was scheduled Monday morning for Joe Fischer, 22, and Hunter Bush, 21. However, their attorney, Fred Peters, said they waived their rights to the hearing, letting the case go to the grand jury to consider possible charges.
In exchange, prosecutors agreed to give Peters access to the entire University of Kentucky Police investigative report, he said.
In late October, Fischer and Bush were arrested after an effigy of the then-Democratic presidential nominee was found hanging from a tree over a walkway on the University of Kentucky campus. The two men were charged with disorderly conduct and burglary for allegedly taking items from a fraternity house to make the effigy.
Fischer and Bush gave statements to campus police admitting guilt, court records stated.
Campus leaders and the governor condemned the act, and a campus vigil was held.
The University of Kentucky is over run with Communist faculty. Do you really think they would hold a vigil for Clarence Thomas or Conde Rice?

Well if they were members of Farmhouse than how can they be charged with burglary? Obviously they didn’t break into their own fraternity house. Disorderly conduct? This charge sounds like a content or view point based restriction on the freedom of speech. I don’t agree with what their actions but come on people this is a free country. No one was harmed and no property was injured.

I agree this was very poor judgment, but I can’t figure out what the crime is. The same thing was done to Sarah Palin in CA and no one cared! Give them community service or something, but don’t waste tax dollars jailing them.
I certainly don’t condone the burglary, theft and disorderly conduct acts of Fischer and Bush. However, I don’t see the “unfortunate effigy incident” as more than a political prank. The powers that be are certainly entitled to their assessment that the effigy was outrageous and offensive. However, it appears that the focus is on the political correctness of the event. From six hundred miles away I see no crime in hanging a model or figurine of a person as a political statement. I also see no evidence of a race or hate theme here!
UK has a diversity department to deal with this kind of behavior, let ole JJ Jackson actually earn her inflated salary (like that’s going to happen), besides an expert disagrees with UK’s focus on diversity saying that the way to actually create awareness is through education. I couldn’t agree more.
Even if the guys charged were members of the fraternity, there is property in fraternity houses that was not theirs, and the taking thereof may have led to the burglary charge.
this is just ridiculous… what about freedom of speech? to me this is the same thing… they didn’t like Obama and found a way to express their views… they didn’t commit a crime… I’m not saying it wasn’t appropriate… but no charges should be filed against them for a prank.. tax dollars should not be wasted on a prank… jail will not be justice for these men…

We may never know the young men’s motives for hanging the effigy. The only thing the public can do is read what the media reports and have enough sense to form their own opinions.
Even if they claim they were politically and not racially-motivated, their behavior was completely and appallingly ignorant. One would hope, as college-educated young men, these two would’ve heard SOMETHING of the history in this country of racial violence in the form of hangings. Out of all the ways to make a political statement, they chose to hang an effigy. Regardless of their true motive - or what they’ll admit to the press - their actions are an embarrassment to the school and the state.
The Lexington police probably covered up the frat incident because the Lexington Police Chief is a farmhouse alum. I remember reading he was part of the farmhouse frat in the paper.
Someone is trying to make a name for themselves by the continuing to prosecute these fine young men for a felony offense. Should it had happened without the effigy it would have been over and live would have gone on. Hence, we can really see what’s happening here. These men do not deserve what wome hope they receive. The deserve far less. One doesn’t have to look far to see the real motive behind it. In fact, you really don’t need to spend much time studying the case to see it for what it is. Drop this charade and conclude as Sergeant Friday by using, “Just the facts, ma’am.” The fact is that there is nothing here but a barnstormer of a political prosecutor that has twisted motives.
I find it amusing…some people have to use my television character to speak for their cause…do they simply believe I am nothing more than a fictional character?…and would never prosecute this case…I have to say…I would…it amusing they use me to try and make their case by speaking for me… I have looked at the facts…and I would prosecute…how sad..the privileged class seems to have lots of privilege…and very little class…
