Man lets police search computer, faces 44 sex charges

A Fayette County grand jury has indicted a Lexington man on 44 charges of sodomy and child pornography.

David M. Allen, 36, is charged with six counts of sodomizing a child under the age of 12, 31 counts of using a minor in a sexual performance (either illicitly filming or photographing a minor), six counts of first-degree sex abuse and one count of possessing matter portraying a sexual performance by a minor.

The indictment was made public Wednesday.

Allen, who works for an electrical contractor in Lexington, is being held in the Fayette County Detention Center on $405,000 bond. He will be arraigned Thursday in Fayette Circuit Court.

According to the indictment, Allen sodomized a child on six occasions from March to May 2008. The accusations that he filmed or photographed minors date back to December 2006.

Fayette Commonwealth’s Attorney Ray Larson declined to comment on the case because it is still pending. Court records did not indicate how he knew the children.

According to a police report, Allen agreed in June to allow police to search his computer. Police said they found images that were suspected to be child pornography.

“The subject stated he had more child pornography on other media,” the police report states.

Bandit robs Lexington postal carrier

Federal authorities and Lexington police are looking for a bandit who robbed a mailman at gunpoint Wednesday morning.

According to preliminary reports, the postal worker was delivering mail in the Woodhill area about 10 a.m. when the gunman stopped him and took his wallet.

Authorities are seeking a black man in his 20s, about 5 feet, 5 inches tall, wearing a brown hoodie and camouflage shorts.

Since the robbery involved the mail, it becomes a federal case.

Judge declares murder suspect competent for trial

ELIZABETHTOWN — A judge in Elizabethtown has found a murder suspect competent to stand trial.

Former Army National Guard soldier Jeremy Shields is charged in the death of Wendy Sue Logsdon, who worked with him at a shoe distribution warehouse in Shepherdsville. Shields pleaded not guilty in April.

Police say Shields used a claw hammer to kill Logsdon inside his parents’ home in Radcliff while they were out of town, then dumped the body in Hart County.

On Tuesday, Hardin Circuit Judge Ken Howard heard a psychiatrist testify that Shields could have flashbacks, nightmares and mentally block out emotionally charged events, due to the effects of his combat experience in Iraq.

However, The News-Enterprise of Elizabethtown reports that the doctor said Shields should be able to help attorneys defend him in court.

Judge extends ban on early prisoner release

SOMERSET — A judge has continued his temporary ban on releasing inmates from a three-county area in Southern Kentucky under new parole rules that have been controversial.

After a hearing Wednesday, Circuit Judge David A. Tapp did not immediately decide whether to impose a longer-term injunction barring such releases — or whether to apply a ban statewide — but promised to rule soon.

The legal fight involves changes that give convicted felons more credit toward the time they get released from jail or from parole supervision. The legislature approved the changes this year.

The goal was to cut the state’s prison population to save money.

Commonwealth’s Attorney Eddy Montgomery urged Tapp to impose an injunction that could stay in place for months to bar releases from prison under the rules.

The Department of Corrections has released more than 2,000 people from jail, prison or parole supervision under the new rules since May. Many will commit new felony crimes within three years, Montgomery said.

“That is a real threat to society,” he said at the hearing.

However, Wesley W. Duke, an attorney for the Justice and Public Safety Cabinet, argued that Montgomery had not met the requirements to have Tapp issue a long-term injunction.

The potential harm Montgomery has pointed to in the releases is speculative, Duke said. Department officials said they haven’t been notified that anyone released under the new rules has committed a new violent crime.

“I think you have to show something beyond what might happen,” Duke told the judge.

He also argued that the new rules are legal and that the department is carrying them out as the legislature intended.

Montgomery sued last week to block releases under the new rules. Tapp issued a restraining order to block them until Wednesday’s hearing.

The issue at the hearing was whether to issue an injunction barring releases until Montgomery’s lawsuit is settled.

Adair man shot, killed; wife charged

The Kentucky State Police charged an Adair County woman in the shooting death of her husband early Wednesday.

Laurie Andrade, 58, was charged with reckless homicide and lodged in the Adair County jail after the incident about 1:30 a.m. Wednesday, police said.

Troopers said they received a call about a shooting on Sand Lick Road, 12 miles south of Columbia, and they found Leonard B. Andrade Jr., 47.

Adair County Coroner Rick Wilson pronounced the victim dead at the scene, police said.

The shooting apparently followed a domestic argument.

The investigation continues.

Prison officer gets 6-month sentence for sex abuse

A former corrections officer at the Federal Medical Center in Lexington was sentenced Tuesday by a federal judge to six months in prison and ordered to perform 180 hours of community service for sexually abusing an inmate under his ward.

Hector Antonio Abelar, 28, of Nicholasville, pleaded guilty in May to charges that he repeatedly had sex with a ward from January to May 2007, according to the U.S. Attorney’s Office in Lexington. Abelar will be required to register as a sex offender.

Abelar will be eligible for parole after serving 85 percent of his sentence.
